4. Construction Quotes and Estimates


Any quote, estimate, budget, pricing information, or project information provided through our website, email, telephone, or other communication is subject to the applicable terms of the project. Unless expressly stated otherwise in writing, estimates are not guarantees of final project costs.

The final cost of a project may be affected by factors including:

  • Changes to the project scope;
  • Client-requested changes;
  • Material price changes;
  • Labour costs;
  • Permit or inspection requirements;
  • Unforeseen site conditions;
  • Structural or existing-condition issues;
  • Delays or changes caused by third parties;
  • Additional work requested or required; and
  • Other circumstances affecting the project.


Any applicable quote or proposal will identify the scope, pricing, assumptions, exclusions, and other conditions applicable to the project.


5. Project Agreements


Construction services provided by Contractors Hub LTD are governed by the applicable written contract, proposal, quotation, purchase order, or other project agreement.

The project agreement may establish:

  • Scope of work;
  • Project price;
  • Payment schedule;
  • Construction schedule;
  • Materials and specifications;
  • Responsibilities of the client and Contractors Hub LTD;
  • Change-order procedures;
  • Warranty provisions;
  • Completion requirements;
  • Insurance requirements;
  • Termination provisions; and
  • Other project-specific terms.

If there is a conflict between these website Terms & Conditions and a signed project agreement, the applicable project agreement will govern the construction project.


6. Changes to Project Scope

   

Construction projects may change during the course of the work.

A client may request changes to the original scope of work. Changes may affect the project price, materials, schedule, labour requirements, or completion date.


Where applicable, additional work or changes will be documented through a written change order or other written approval.

Contractors Hub LTD is not responsible for delays or additional costs resulting from client-requested changes or delayed client decisions, approvals, selections, or instructions.


7. Existing and Unforeseen Site Conditions


Construction and renovation projects may involve conditions that cannot reasonably be identified before work begins.

These may include concealed structural issues, existing damage, hazardous materials, unsuitable soil, hidden utilities, outdated systems, moisture, mould, or other conditions that were not reasonably apparent during initial assessments.


If unforeseen conditions are discovered, Contractors Hub LTD will communicate the issue to the client where reasonably possible.

Additional work required to address unforeseen conditions may result in additional costs and/or changes to the project schedule, subject to the applicable project agreement and applicable law.


8. Project Scheduling and Delays


We make reasonable efforts to complete projects according to the agreed schedule. However, construction schedules can be affected by circumstances outside our reasonable control.

These may include:

  • Severe weather;
  • Material shortages or supplier delays;
  • Labour shortages;
  • Permit or inspection delays;
  • Utility interruptions;
  • Unforeseen site conditions;
  • Client-requested changes;
  • Delayed approvals or decisions;
  • Actions or delays of subcontractors or other third parties;
  • Government requirements;
  • Emergencies;
  • Acts of nature; and
  • Other circumstances beyond our reasonable control.

Where reasonably possible, Contractors Hub LTD will communicate significant schedule changes to the client.


9. Client Responsibilities


Clients are expected to cooperate with Contractors Hub LTD throughout the project.


Depending on the project, client responsibilities may include:

  • Providing reasonable access to the property;
  • Providing accurate project information;
  • Providing timely approvals and decisions;
  • Making required selections;
  • Providing access to relevant documents and information;
  • Keeping required areas accessible;
  • Making payments when due; and
  • Complying with responsibilities established in the applicable project agreement.

Delays resulting from failure to meet these responsibilities may affect project costs and timelines.


10. Permits, Approvals and Regulatory Requirements


Construction projects may require permits, inspections, approvals, drawings, engineering, or other regulatory requirements.

Responsibility for obtaining specific permits or approvals will be determined by the applicable project agreement and the requirements of the relevant authorities.


Clients are responsible for providing accurate information and cooperating with Contractors Hub LTD and applicable authorities where required.


11. Subcontractors and Suppliers


Contractors Hub LTD may engage qualified subcontractors, tradespeople, suppliers, consultants, or other professionals as necessary to complete a project.


The use of subcontractors and suppliers does not relieve Contractors Hub LTD of its obligations under the applicable project agreement.


12. Payments


Payment terms are established in the applicable contract, proposal, quotation, invoice, or other project documentation. Clients are responsible for making payments according to the agreed payment schedule. Failure to make payments when due may result in suspension of work, delays, additional costs where permitted by the applicable agreement and law, or other remedies available to Contractors Hub LTD. Any payment-related rights and obligations will be subject to the applicable contract and applicable Ontario law.


13. Warranties


Any warranties provided by Contractors Hub LTD will be governed by the applicable project agreement.

Certain materials, products, equipment, or systems may also be subject to manufacturer or supplier warranties.

Unless expressly provided in writing, information on this website does not create or extend any warranty.

Nothing in these Terms & Conditions is intended to exclude or limit any warranty, protection, or right that cannot legally be excluded or limited under applicable law.


14. Safety


Contractors Hub LTD is committed to maintaining a safe working environment and following applicable workplace health and safety requirements. Construction sites may contain hazards and restricted areas.

Website visitors, clients, contractors, and other persons must not enter restricted construction areas without appropriate authorization.
